Welcome to GigBookerAI. By creating an account or using our platform, you agree to these Terms of Service ("Terms"). GigBookerAI is operated by SCJON Enterprises LLC ("we," "our," or "us").

1. Acceptance of Terms

By accessing or using GigBookerAI at gigbookerai.com, you agree to be bound by these Terms. If you do not agree, do not use the platform.

2. Description of Service

GigBookerAI is a band management and booking platform that provides tools for managing bands, booking gigs, tracking finances, creating contracts, managing substitute musicians, and connecting bands with venues. The platform serves band administrators, band members, booking agents, substitute musicians, and venues.

3. Account Registration

• You must provide accurate, complete information when creating an account
• You are responsible for maintaining the security of your password
• You are responsible for all activity that occurs under your account
• You must be at least 13 years old to create an account
• One person may maintain one account (with multiple roles: admin, member, sub, venue, agent)
• During closed beta, an invite code may be required to create an account

4. User Roles & Responsibilities

Band Administrators are responsible for the accuracy of their band's information, member management, and financial configurations. Payment split calculations are tools — the admin is responsible for ensuring members are paid correctly.

Band Members are responsible for keeping their availability and contact information current.

Venues are responsible for the accuracy of their venue profile, capabilities, and contract commitments.

Booking Agents are responsible for acting within the authority granted by the bands they represent.

5. Contracts & E-Signatures

• GigBookerAI provides tools to create, send, and sign performance contracts electronically
• Electronic signatures created through our platform are intended to be legally binding between the signing parties
• GigBookerAI is not a party to any contract between bands and venues — we are a platform, not a booking agency
• We do not guarantee the enforceability of any contract created on the platform
• Users are responsible for the content and terms of their contracts
• We recommend consulting a legal professional for high-value or complex engagements

6. Payment & Financial Tools

• GigBookerAI provides payment calculation tools (splits, commissions, fund tracking) for informational purposes
• We do not process payments between bands, members, venues, or agents
• All actual payments are handled outside the platform between the parties
• Financial calculations are based on data entered by users — we are not responsible for errors in user-entered data
• Earnings reports and tax documents are generated from user data and should be verified with a tax professional

7. Subscription Plans & Pricing

• Band members, sub musicians, and basic venue accounts are free
• Band admin accounts require a paid subscription after any trial period
• Pricing is listed on our website and may change with 30 days notice
• During beta, all features are available free of charge
• Subscriptions can be cancelled at any time — access continues until the end of the billing period
• We do not offer refunds for partial billing periods

8. Content & Data Ownership

• You retain ownership of all content you create on the platform (band profiles, contracts, set lists, photos, etc.)
• By making content public (e.g., enabling your EPK), you grant us a non-exclusive license to display that content on the platform
• You may export or delete your data at any time by contacting us
• We do not claim ownership of your music, photos, contracts, or financial data

9. Acceptable Use

You agree not to:

• Use the platform for any illegal purpose
• Create fraudulent contracts or misrepresent your identity
• Harass, abuse, or threaten other users
• Scrape, crawl, or automated data collection from the platform
• Attempt to access other users' accounts or data
• Upload malicious content, viruses, or harmful code
• Use the platform to spam venues or musicians with unsolicited messages
• Post false reviews or manipulate the band ranking system

10. Reviews & Community Content

• Reviews must be honest and based on real experiences
• We reserve the right to remove reviews that are fraudulent, abusive, or violate these Terms
• Community board posts (musician availability, band wanted) expire after 30 days
• Venue warnings are community-contributed and reflect individual experiences — they are not verified by GigBookerAI

11. Intellectual Property

• GigBookerAI, our logo, and our platform design are trademarks of SCJON Enterprises LLC
• You may not copy, modify, or distribute our platform code, design, or branding without written permission
• The GigBookerAI software is protected by US Copyright (Case #1-15140067771)

12. Limitation of Liability

GigBookerAI is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

• We are not liable for any disputes between bands, members, venues, or agents
• We are not liable for missed gigs, payment disputes, or contract disagreements
• We are not liable for data loss, though we take reasonable measures to prevent it
• Our total liability is limited to the amount you paid us in the 12 months preceding any claim
• We are not responsible for the actions of any user on the platform

13. Account Termination

• You may delete your account at any time by contacting us
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your data will be retained for 30 days and then permanently deleted
• Band data (gigs, contracts, member records) may be retained if other active users depend on it

14. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of the platform after changes constitutes acceptance. For material changes, we will notify you via email or in-app notification.

15. Governing Law

These Terms are governed by the laws of the State of Texas, United States. Any disputes will be resolved in the courts of Dallas County, Texas.
